The most common legislative article to consider in retail consultancy is the Offices, Shops and Railway Premises Act, however in recent times, other statutes have had a marked effect on how retailers can consider their properties.
These include;

The Equality Act 2010 (DDA 2004)

2004 saw the enforcement of the Disability Discrimination Act giving Councils and Local Authorities the powers to have publicly accessible properties retrospectively upgraded to facilitate disabled people.

This includes access ramps, disabled toilets and visual aids. The general parameters of this have now been encompassed in the Equality Act 2010.

Health & Safety Audit

A general obligation exists in respect to Health & Safety. Ramsay McMichael Consulting are able to carry out an audit to determine compliance and identify a strategy for remedial action relating to any deficiencies.

The Fire (Scotland) Act 2005 and the Regulatory Reform (Fire Safety) Order 2005

This new legislation supersedes much of the previously existing fire safety legislation, for example Fire Certificates will no longer be issued and the emphasis is now on Fire Risk Assessment. The legislation imposes a general duty of fire safety care on a “Responsible Person” and also on any other persons in control of buildings.

Ramsay McMichael Consulting are experienced in carrying out Fire Risk Assessments, fulfilling the role of Assessor on behalf of the deemed “Responsible Person”.

Asbestos Audit

Persons responsible for non - domestic properties are required to know if there is any asbestos present in their premises, its extent and condition. This enables any ACMs (asbestos containing materials) to be managed by advising building occupants and anyone else liable to come into contact with it. The control of Asbestos Regulations 2012 defines such a person as the “duty holder” and this can either be anyone who owns, manages or occupies a property.

Ramsay McMichael Consulting undertake Asbestos Audits for commercial, industrial and retail property types. This can take on the form of assisting in the production of audits over singular or multiple properties, and the formulation of an Asbestos Register, which would be used for identification, monitoring and review purposes on an annual basis for all ACMs determined during the course of the audit inspections.
